Terms and Conditions

SportsFox Photography LLC

Effective Date: August 2024

1. Agreement and Acceptance

By booking a photography session, purchasing products, or using our services, you ("Client") agree to be bound by these Terms and Conditions. This agreement constitutes the entire agreement between SportsFox Photography LLC ("Photographer," "we," "us," or "our") and the Client.

2. Services Provided

2.1 Photography Services

We provide professional photography services including but not limited to:

  • Portrait photography

  • Event photography

  • Game photography

  • Photo editing and retouching

  • Digital image delivery

  • Print and product sales

2.2 Service Limitations

  • Services are provided based on the specific package or agreement selected

  • Additional services beyond the contracted scope may incur extra charges

  • We reserve the right to refuse service for any reason

3. Booking and Contracts

3.1 Booking Process

  • All bookings require a signed contract and non-refundable deposit

  • Verbal agreements are not binding; all agreements must be in writing

  • Session dates are not guaranteed until deposit is received

3.2 Contract Requirements

  • Contracts must be signed by all legal guardians for minors

  • Corporate bookings require authorization from an authorized representative

  • Changes to contracts must be agreed upon in writing by both parties

3.3 Deposit and Payment Terms

  • A 50% deposit is required to secure booking

  • Remaining balance is due before final image delivery

  • Late payments may result in suspension of services and additional fees

  • Returned checks incur a $35 processing fee

4. Session Policies

4.1 Preparation and Arrival

  • Clients must arrive on time and prepared for their session

  • Late arrivals may result in shortened session time without refund

  • Rescheduling due to client tardiness may incur additional fees

  • Clients are responsible for bringing appropriate clothing and props

4.2 Session Conduct

  • Professional behavior is required from all participants

  • We reserve the right to end sessions due to inappropriate conduct

  • Alcohol or drug use during sessions is prohibited

  • Parents/guardians must supervise minors at all times

4.3 Location and Setup

  • Outdoor sessions are subject to weather conditions

  • Location fees, permits, or travel costs may apply

  • Client is responsible for securing necessary permissions for private locations

  • Setup and breakdown time is included in session duration

5. Image Delivery and Rights

5.1 Delivery Timeline

  • Edited images will be delivered within 2-4 weeks of session

  • Rush delivery may be available for additional fee

  • Client will be notified of any delays beyond promised delivery date

  • Images are delivered via secure online gallery

5.2 Image Selection and Editing

  • Photographer selects which images to edit and deliver

  • All images are professionally edited at photographer's discretion

  • Raw or unedited images are not provided

  • Specific editing requests may incur additional charges

5.3 Copyright and Usage Rights

  • Photographer retains full copyright to all images

  • Client receives limited license for personal use only

  • Commercial use requires separate licensing agreement

  • Images may not be altered without written permission

6. Photographer Rights and Usage

6.1 Portfolio and Marketing Rights

  • We reserve the right to use images for business purposes including:

  • Portfolio display

  • Website galleries

  • Social media marketing

  • Advertising and promotional materials

  • Contest submissions

  • Publication submissions

6.2 Opt-Out Options

  • Clients may opt out of marketing usage by providing written notice

  • Opt-out requests must be made before the session date

  • Opting out does not affect copyright ownership

7. Cancellation and Rescheduling

7.1 Client Cancellations

  • 14+ days before session: Full refund minus processing fees

  • 7-13 days before session: 50% refund

  • Less than 7 days: No refund of deposit

  • No-show: No refund, full balance due

7.2 Photographer Cancellations

  • Full refund if we cancel due to emergency or illness

  • Alternative photographer referrals provided when possible

  • Priority rebooking offered when available

7.3 Weather Rescheduling

  • Outdoor sessions may be rescheduled for severe weather

  • Light rain or overcast conditions do not constitute severe weather

  • Indoor backup plans may be suggested

8. Liability and Insurance

8.1 Limitation of Liability

  • Our liability is limited to the total amount paid for services

  • We are not liable for missed shots due to circumstances beyond our control

  • Equipment failure, technical issues, or acts of nature do not constitute grounds for refund

8.2 Client Responsibility

  • Clients are responsible for their personal belongings during sessions

  • We are not liable for damage to client property or clothing

  • Clients assume risk for outdoor or adventurous session locations

8.3 Insurance Coverage

  • We maintain professional liability insurance

  • Proof of insurance available upon request

  • Additional insurance may be required for certain venues or events

9. Force Majeure

Neither party shall be liable for any failure or delay in performance under this agreement due to circumstances beyond their reasonable control, including but not limited to:

  • Natural disasters

  • Government regulations

  • Pandemic restrictions

  • Transportation strikes

  • Equipment failures

10. Intellectual Property

10.1 Copyright Protection

  • All photographs are protected by federal copyright law

  • Unauthorized reproduction, distribution, or display is prohibited

  • Copyright infringement may result in legal action and damages

10.2 Social Media Usage

  • Client may share images on personal social media with credit

  • Photographer must be tagged or credited when sharing

  • Commercial social media accounts require separate licensing

11. Privacy and Data Protection

11.1 Information Collection

  • We collect only information necessary to provide services

  • Payment information is processed through secure third-party processors

  • Client information is not shared with unauthorized parties

11.2 Image Storage and Security

  • Images are stored on secure, encrypted cloud servers

  • Client galleries are password-protected

  • Images may be archived for portfolio and legal purposes

12. Dispute Resolution

12.1 Governing Law

This agreement is governed by the laws of Pennsylvania, without regard to conflict of law principles.

12.2 Dispute Process

  • Initial disputes should be addressed directly with the photographer

  • Mediation may be required before legal action

  • Any legal proceedings must be filed in Dauphin County Court of Common Pleas (for state matters) or U.S. District Court for the Middle District of Pennsylvania (for federal matters).

12.3 Attorney Fees

The prevailing party in any legal action may be entitled to reasonable attorney fees and costs.

13. Modifications and Updates

13.1 Agreement Changes

  • These terms may be updated periodically

  • Clients will be notified of material changes

  • Continued use of services constitutes acceptance of updated terms

13.2 Individual Modifications

  • Modifications to individual contracts must be in writing

  • Verbal modifications are not binding

  • Both parties must sign any contract amendments

14. Severability

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
